Legal Status of an Employee According to the Labor Legislation of the Russian Federation

This work is devoted to the study of the legal status of an employee in the light of modern Russian legislation. The topic appeared to be especially relevant during the period of increasing competition in the labor market caused by the effects of the economic and foreign policy crisis in Russia. Nowadays there is a steady increase in the number of cases related to problems with the process of employment and dismissal of workers. In this regard, each of us as a potential employee should learn his rights and obligations in order to avoid such difficulties in the future. In this paper author defines the notion “legal status of an employee” in labor relationships, explains the grounds for establishment of labor relationships, clarifies the rights and duties of an employee, reveals the problems in the enforcement of labor law and suggests ways of their solution on the basis of profound analysis of labor legislation, judicial documents and publications of academic and practicing lawyers.
