Recognition and Execution of Foreign Judicial Acts in the Arbitration and the Civil Proceedings

This work is devoted to the research of the institution of foreign judicial acts recognition and execution in the territory of the Russian Federation, particularly, its legislative control, theoretical positions in this regard, approaches established in the judicial practice and foreign countries’ experience in this sphere. The subject of the research is thought to be topical due to the fact that existing state of the institution of foreign judicial acts recognition and execution does not correspond to the realities of the modern world and the growing pace of the development of relationships between people and organization in the transnational level. For this reason, nowadays, the most effective way of the institution of foreign judicial acts improvement is been researched. In this regard, it is considered to be important to analyze its problematic aspects and propose ways of their perfection. In this paper the comparative analysis of the procedural legislation in this sphere is made. Moreover, types of judicial acts and procedures of their recognition and execution are studied. Besides, a part of the work is devoted to the research of legal grounds for foreign judicial acts recognition and execution, particularly, possibility of the principle of legal reciprocity use in this regard. What is more, possibility of the existence of the reciprocity observance assumption, methods and procedural peculiarities of such observance establishment are investigated.
