The legal nature of Public-private Partnership

Annotation The work is devoted to the legal nature of a public-private partnership in the Russian Federation (PPP). The purpose of research: qualification PPP institution in the Russian Federation. The tasks set to achieve the objectives: identification of specific features of PPP; definition of PPP place in the system of law of the Russian Federation; the formation of recommendations for optimizing the investment legislation based on the findings of the study. The object of study: the legal relationship between private traders PPP. Subject of research: investment and civil law, research and development devoted to consideration of investment relations in general and relations in the framework of PPP, in particular. Relevant juridical practice. The novelty of the study due to the small number of studies devoted to the consideration of the legal nature of the PPP, as well as put forward the hypothesis that the PPP is a form of implementation of investment agreements, complicated by the presence of a public element. Practical value: the presence of recommendations to improve the investment legislation of the Russian Federation. In accordance with the intended purpose, it resolved a number of practical problems: were identified features that characterize the PPP institution for determining its place in the system of the Russian Federation law. Resolution objectives contribute to achieving the ultimate goal - the definition of the legal nature of the PPP. In addition, consideration was subjected to a legal instrument by which the legal relationship established under PPP - an agreement on public-private partnership. It was possible to establish its legal nature and the relationship with the structure of the investment agreement. These findings contributed to the specification of the legal nature of the PPP and the definition of this institution in the place of the investment law system.
