Legal Positions of the Сonstitutional Court of the Russian Federation in the Sphere of Realization of the Right to Judicial Protection

Research is devoted to the analysis of the legal positions of the Constitutional Court of the Russian Federation on the implementation of the right to judicial protection. The author analyzes in detail the questions of the legal status of the legal position in the constitutional system of sources of law, addressed the specific legal acts and systematization and compilation of relevant jurisprudence. Further, the author deal with the application of legal positions, which are contained in the definition of the Constitutional Court, and considered changing the existing legal regulation of the exercise of the right to judicial protection by challenging the acts with regulatory properties. In conclusion, the author summed up the results of the study and noted the high role of the legal positions of the Constitutional Court of the Russian Federation in the filling of the constitutional content of the right to judicial protection
