Legislation on procurement for state and municipal needs is traditionally difficult to use. Moreover, the simultaneous action of two federal laws that regulate the activity of various types of organizations (the Federal Law 44-FZ and the Federal Law 223-FZ) significantly comlicates the public procurement situation. Noteworthy that 223-FZ Act provides the corporative buyers with the choice: do not use the procurement of 223-FZ and use procurement of 44-FZ. In such case the following questions are of interest: Do all customers who are subject to the principles of the Federal Law №223-FZ have to set the Regulation on procurement? Can an organization choose the law under which the procurement will be carried out? May it increase the effectiveness of the organization's activities in the area of ​​procurement? In this study, the purpose of the work was achieved: recommendations for buyers with choice of 223-FZ or 44-FZ procurement were made. The case of the state-owned corporation "Rosatom" procurement within 44-FZ and 223-FZ in 2015 and the analysis of of procurement effectiveness showed that the hypothesis about the effectiveness of free choice between the activities of the 44-FZ and 223-FZ was not confirmed.
