Personal Data Security in Labor Law of the Russian Federation

The goals of this graduate qualifying work are to disclose the essence of the institution of personal data security; in the disclosure of methods of protecting the personal data, and in the formation of proposals for improving the organizational standards for protecting this category of information. The primary objectives of the study are: A)conducting a legal study of the formation of the institution of personal data; B)selecting, analyzing and summarizing sources of information; C)the identification of the legal essence of the category of «personal data»; D)consideration of the status of the subject and the object of personal data; E)consideration of the rules for the turnover of personal data; F)the definition of the problem of protecting the personal data and methods for solving it; G)examination of the types of responsibility for violation of the appropriate rules; H)presentation of conclusions on the theme. On the basis of the analysis, the conclusions are formulated: firstly, the main consequence of offenses in the field of data protection is in most cases the incompetence of personnel department. Secondly, the Government of the RF should develop rules that regulate the procedure of the storage and use of personal data in organizations. Thirdly, all mechanisms for obtaining information about employees should be used only in accordance with properly adopted internal organizational provisions. Fourthly, it is required to obtain employee's consent to restrictions on their privacy. Fifthly, the data to be collected must relate only to the official activities of the employee. Sixthly, any information about the employee should be obtained from legitimate sources.
