The Franchising Agreement in the Civil Law of the Russian Federation

This paper is devoted to the concept of the Franchising Agreement in Russian Civil Law. This sphere is actual and interesting to be researched, because with the development of entrepreneurship, Franchising is becoming more important and common. The legislature, that regulates this type of agreement has several gaps and needs to be developed. Furthermore, there are many controversial opinions concerning the difference between the Franchising Agreement and its Russian equivalent – Commercial Concession Agreement. Current research starts with analyzing general norms that regulate Franchising Agreement. In this part, the research also explains the difference between the Franchising Agreement and Commercial Concession Agreement and shows how these two terms correlate. After that, the author makes an attempt to stress the most sufficient conditions of the Franchising Agreement. It should be mentioned that the Franchising Agreement is one of the most risky types of Agreements. That is why he author summarizes most common mistakes in these agreements and the conditions of the agreement that are advised to be avoided while entering into the Franchising Agreement.
