Legal Regulation of Adrogation in the Russian Federation: Problems and Ways of Improvement

The present investigation is dedicated to the complex legal analysis of adrogation in the Russian Federation based on review of national and international legal instruments and law enforcement practice concerning adrogation. The aim of the paper is to consider the actual problematic issues of adrogation in Russia and to propose the ways of its solving. The introduction is devoted to the examination of topicality, object, subject, aim, tasks and methods of the work. The first chapter contains doctrinal approaches to legal nature of adrogation, legal characteristics of adrogation, conditions and procedural aspects of adrogation. Moreover, contemporary problems are founded out, mechanisms of solution are suggested. Legal implications of adrogation and grounds for adoption annulment are studied in the second chapter of the present investigation. Besides, the paper provides valuation of necessity of secret of adrogation and measures to increase adopted children in the Russian Federation. The conclusion concentrates definitive outputs of the research. The results of the exploration are presented by the following statements. First of all, Russian legislator should introduce the mechanism that allows filing of application about adrogation of children who has not been born yet. Secondly, the significance of legislative consolidation of qualification requirements to employee of children's services is proved. Thirdly, the criteria to prospective adoptive parents should be changed in the national legal instruments. Finally, the secret of adrogation should be defeated and the size of state benefit paid to one of adoptive parents should be increased.
