The Problems of Demarcation of Jurisdiction

Problem of demarcation of cognizance is one of the central in the Civil Procedural Law because it is one of basic principle of realization of citizen’s right to judicial protection. Scientists mostly concentrate on the aspects of the problems of the Institute of Cognizance underestimating fundamental research. This article demonstrates that comprehensive analysis based on the understanding of nature and system of the Institute is the only way to improve legal regulation reasonably. In response to this situation a row of scientific researches was analyzed with the aim of theoretical and methodological analysis and systematization of present theoretical and scientific-practical developments of cognizance’s problems in Russian Civil Procedural Law. The main finding of the research is the definition of cognizance and founded correlation between this Civil Procedural Institute and others.
