Discrimination in Labour Relations

The research is aimed to scrutinize the definition of discrimination in labour relations and draw a line between the notion, prescribed by the Russian labour code, and the one contained in various international legal acts. In addition, the research makes an attempt to single out some principal differences in the legal regulation of prohibition of labour discrimination in the Russian Federation and other countries and, of course, to analyze the phenomenon of labour discrimination through a number of most vivid and high-profile case-law of both Russian and international courts. Despite its direct legal enshrinement into the Constitution of the Russian Federation and the Labour code of Russia, the phenomenon of labour discrimination has not turned into a relic of the past but, on the contrary, is being frequently exercised in practice. Thus, the author of this research tries to find out which legal lacunas exist in the current Russian labour legislation and gives useful recommendations for the improvement of anti-discrimination mechanisms, taking into account the experience of foreign countries.
