The Legal Regime of Intellectual Property at Physical Culture and Sport

The purpose of present study is to determine the procedure for the regulation of intellectual property in the field of physical culture and sports. The author of the study had the following tasks: to identify and characterize sources of legal regulation of intellectual property in the field of physical culture and sports; highlight intellectual property used in the sphere of physical culture and sports, and to disclose in detail the peculiarities of legal regulation of the most widely used of them; to reveal the author's opinion on the problematics; to determine how to use the intellectual property in the sports industry; to determine the presence or absence of conflicts or gaps in law as part of the topic, if available - to offer solutions to the problem. The methodological basis of the research consists of analytical, systemic and comparative methods, a formal legal method and a system-structural method. In accordance with the tasks set, the regulatory and legal framework, judicial practice, foreign experience, as well as scientific works on this issue were studied. The author of the study identified intellectual property in the field of physical culture and sports, considered ways to dispose of rights to objects of intellectual property in the field of sports, highlighted the legal regulation of the brand in the sports industry and broadcasts of the sports competitions. According to the findings of the study, the current legislation in the framework of establishing the legal regime of intellectual property in the sports industry, as well as the legal regulation of the sphere of sports in general, is at the development stage, however, the authorized bodies are working to develop and improve the regulatory framework. The proposed changes in the study, according to the author’s opinion, could become actual trends in the development of legislation in the sports sphere.
