Protection of Personal Data in Labor Law

Over the last few years, we can observe significant changes social and labour relations go through. Current legislation of the Russian Federation regulates personal data protection, which is being developed and improved. The regulation of responsibility for personal data protection was amended in the Administrative Code of the Russian Federation in 2017. The cases of administrative responsibility have been described in detail; the fines for offences in this legislation area have been increased. The actions undertaken by the government show current interest to this subject. The objective of this research is to identify and develop in-depth, systematized representation of theoretical and legislative framework of personal data protection, national and international laws and regulations and to analyze the problem of responsibility for offences in this particular area. The author describes theoretical and legislative aspects of personal data protection, analyzes national and international laws and regulations, identifies their correlation. The different types of responsibility for inappropriate insufficient personal data protection are reviewed in his research. The author also makes an emphasis on the case studies, when the employer may potentially hurt the interests of the employee in terms of personal data protection and suggests possible ways of conflict resolution.
