Attorney's Right to Income

The research is focused on attorney’s right to income. The totality of fee for different activity constitutes attorney’s income altogether. Despite the centuries-old history of the existence of this institution of civil procedural law, the relations of legal representation in the civil process, the legal status of the attorney, the regulation of the relations of process representation remain the subject of serious discussions in the professional field. There are numerous problematic features of attorney’s fee. The main purpose of the research is to explore advocate’s income in all its manifestations. The research includes: analysis of legal basis for the attorney’s activity in the Russian Federation, determination of the nature of advocate’s status, differentiation of attorney’s income and revenue from participation in law firms, description of the ways of getting individual advocate’s income, retrospective analysis of lawyer's code of professional ethics, an opinion about an opportunity to merger entrepreneurship and advocacy based on current legislation, consideration of such adjacent aspects of advocate’s fee as taxation and ways of protecting attorney’s right to income, experience of foreign countries in such sphere.
