Penalty in Russian Civil Law: Problems of Theory and Practice

Despite the fact that the penalty is one of the oldest classical institutions that protect the rights of creditors in Russian civil law, its legislative regulation for several decades raises a number of theoretical and practical questions. Particular attention in the final qualifying work is paid to the problems of law enforcement practice, including the calculation of the Statute of limitations on the demand for the recovery of a penalty, the analysis of recent changes in Art. 333 of the civil code, as well as the provisions contained in the Resolution of the Plenum of the Supreme court № 7 dated 24.03.2018 "On the application by the courts of certain provisions of the Civil code of the Russian Federation on liability for breach of obligations" and explaining the procedure for the application of the rules of penalty in contractual relations. In the final qualifying work also contains a description of the penalty, a comparative analysis of the views of this institution, presented in the doctrine.
