The Role of the Defense Counsel in a Criminal Process of Modern Russia

The aim of this work was to search for the most significant problems arising in practice in connection with the implementation by defense attorneys of their powers in the framework of the criminal process in modern Russia. The author has identified the main violations of the rights of lawyers that do not allow the full implementation of the lawyer’s activities effectively, identifies the main forms of opposition to the lawful activities of lawyers. It justifies the need to strengthen the legal guarantees of advocacy, to establish at the legislative level effective mechanisms for the defense of a lawyer in the exercise of his legal professional activities, a number of proposals are made to improve the legislation.The author draws the reader’s attention to the following key problems of the institution under study that are relevant today:  problems of adherence to attorney-client privilege: violations during the search, inspection and seizure of defense attorney; illegitimacy of interrogation of defense attorney; attorney’s internship attorney secrets;
