Legal Aspects of Digitalizing HR Document Flow

The thesis covers an important topic that hasn’t been properly studied yet: at the moment there are no comprehensive full-fledged studies dedicated to this issue. In the first chapter ‘Switshing to Electronic Document Management in the Context of the Labor Law Regulations’ the auther assesses legal regulation of electronic document management in the Russian Federation and the prospects of switching to electronic document management system from the position of labor law. Main grounds for e-document management date back to the 1990s, in the early 2000s it gained momentum in almost all areas of activity. E-document management in Russia is primarily regulated by the Federal Law No. 149-FZ of July 27, 2006 ‘On Information, Informational Technologies And The Protection Of Information’ and the Federal Law No. 63-FZ of April 6, 2011 ‘About the Digital Signature’. The first chapter covers possible risks and costs in switching to electronic HR document management and the problem of storage security. The author also offers her definition of ‘electronic document management’. The second chapter ‘International Regulation of Electronic Document Flow’ features a brief comparative analysis of the regulation of e-document flow in BRICS, EAEU and a number of other countries, ISO standards and national GOST standards. Almost everyone uses electronic documents in their work. E-documents are important sources of information with legal force. Principles, methods and terms of e-document storage should be key processes of document management. Today there are no unified regulations for storing electronic documents in HR document management. The thesis covers recommendations and standards applied to document management in Russia and the role of the Archival Fund of the Russian Federation in this process. In conclusion, the author covers main findings of the study.
