The Procedure of Consideration Athletes’ and Coaches’ Individual Labor Disputes

The purpose of the study is a comprehensive analysis of the material and procedural component of individual legal disputes of athletes, the study of the concept, specifics and types of sports disputes, analysis of the activities of various jurisdictional bodies on this issue. The objectives of the study are: - Definition of the concept and content of an individual labor dispute; - Selection of specific signs of a sports dispute and its concepts; - Study of the classification of sports disputes; - The study of the procedural aspects of the consideration of labor disputes of athletes by courts of general jurisdiction and jurisdictional bodies of sports federations; - Isolation of the problem of resolving labor disputes of athletes and the creation of proposals for its resolution. In the course of the dissertation research, the authors turned to the dialectical and materialistic methods of cognition of reality that are classical for legal science, and they used the formal-logical method and the method of structural analysis. In order to study sports law in the context of its labor component, a comparative legal method was used, as well as an analysis method. When considering the stages of development of a sports dispute, as well as changes in the legal regulation of the institutions under consideration, the historical and legal methods were used. As part of the study, the concept of individual labor disputes was studied, various classifications of labor disputes were analyzed, the jurisdiction of athletes' labor disputes was studied, and an analogy with practice in different countries was made. The study revealed the main problems of the relevant institute of law, made conclusions. In order to improve the sports legislation, the study proposed to fix specific definitions, and also formulated proposals for improving the industry.
