Authors' of Digital Works Exclusive Rights Legal Regulation

The paper covers the problems of legal regulation when using works expressed in digital form on the Internet. The digital form of the works creates many problems of legal regulation. Due to the ease of copying works expressed in digital form, the authors face the problem of violation of their rights, since borrowing content and using it to create derivative works are often carried out on illegal grounds. The emphasis is made on creative works that are daily published on the Internet, and are easily distributed among its users. In the presented work, an analysis of legislation and judicial practice was carried out, the legal status of works expressed in digital form was reviewed, ways of disseminating works on the Internet were analyzed, allowing the most effective way to observe the balance of interests; considered the impact of technology on the regulation of exclusive rights. The methodological basis of the work consists of such methods as analytical, formal legal, comparative legal, sociological. As a result of the study, problems of legal regulation of the digital form of works, problems of protecting the exclusive rights of authors when using their works on the Internet were identified. Analyzed how technological solutions allow to solve problems of authors' of digital works exclusive rights legal regulation.
