The Amount of Compensations for Rehabilitating Circumstances in Criminal Proceedings

The aim of the graduation research is to analyze the state of the rehabilitation institute today, as well as to assess the proportionality of compensations paid in the Russian Federation for harm caused by unlawful and unjustified criminal prosecution. To achieve this goal, the following tasks should be resolved: 1. To study the structure and mechanism of the institution of rehabilitation. 2. To analyze the jurisprudence on issues of redress and compensation for rehabilitated persons. 3. To formulate proposals for changing certain aspects to improve the development of the institution of rehabilitation. By fulfilling the tasks, the goal of the graduation work was achieved, and proposals were formulated that should eliminate the situation of inadequate assessment by the Russian courts in relation to the amount of compensation paid to rehabilitated persons. Ideally, strive for the level set by the European Court of Human Rights and assess the moral and physical suffering of a person who has suffered unlawful and unjustified criminal prosecution, in accordance with fair and reasonable criteria, where human life is the highest value for the state.
