Proving in Cases about Compensation for Violation of the Rules of Reasonable Term

The author notes that the provisions on a reasonable time limit are formulated in Russian legislation in a vague manner and that the category of "circumstances making it difficult to consider a case" does not give any insight into the criteria by which a given actual term of consideration of a case can be considered a violation of a reasonable term. The author proposes the understanding of a reasonable period of time as such consideration of a case (complaint) by the court, in which there have been no violations of procedural rules involving an increase in the period of consideration of the case (complaint). At the same time, the paper notes that the plaintiff (applicant) to satisfy his claim to the state to recover compensation for the violation of a reasonable period of court proceedings must refer to specific actions (inaction) of the court, which violated his rights, namely, increased the term of consideration of the case (complaint).
