Legal Basis for Working with Staff

The work presents a set of legal studies of theoretical and practical aspects of the regulation of personnel hiring. The first chapter is devoted to theoretical basis of legal framework for working with staff. It reveals historical aspect of legal regulation of labour and carries out its correlation with the development of personnel management theory. Russian labour legislation has been modified depending on the approaches to personnel management. The second chapter examines the legal regulation of a narrower area of ​​work with personnel - the selection procedure. Here the basic concepts of personnel selection are considered. Additionally, its methods and sources of attraction are described. Forms of staff recruitment are also studied in detail, each of which correlates with current legal norms. Next, the legal requirements for the recruitment procedure are examined, which sets out the basic legal norms both at the federal level and local, within the organization. The third chapter consists of an analysis of judicial practice on the recruitment procedure, outlines the main criteria for the unsatisfactory claims in court and vice versa. Also on the basis of the theoretical material and practical examples, the main problems of legal regulation of work with personnel, in particular, the personnel selection procedures, were identified. In conclusion, recommendations were developed for solving these problems and improving Russian labour legislation.
