Antitrust Compliance in the Russian Federation as a Tool for Preventing Violations of Antimonopoly Legislation

Antimonopoly compliance is a special internal system for preventing the commission of an offense in the field of antimonopoly legislation. The procedure for implementing antimonopoly compliance is regulated only for state authorities now, which does not allow economic entities to effectively apply this system and prevent violations of antimonopoly legislation. In addition, the existing guidelines are not sufficiently developed, as they do not fully reflect all the features of this system. The consequence of this is heterogeneous, not unified acts of compliance, which do not allow us to fully assess the effect of the measures taken, the number of offenses prevented. It seems necessary not only to supplement the Methodological Recommendations with provisions explaining the specific procedure for organizations, but also to issue a separate act regulating the procedure for applying antitrust compliance by corporations. The authorities need to assess all possible types of violations, as well as take into account all control and supervisory measures of higher authorities. Currently, business entities can be guided by Methodological Recommendations for government authorities, however, the publication of separate recommendations for corporations will allow companies to assess the risks of violating anti-monopoly legislation in a timely manner to preserve financial stability and reputation.
