Cryptocurrencies in International Banking Law

Relevance of the research topic. With the popularization of blockchain technology and cryptocurrencies in society, legislators of all countries are faced with the problem of legal regulation of the release and circulation of cryptocurrencies. Within the framework of this work, approaches to determining the legal nature of cryptocurrencies, as well as ways of their legislative regulation, are analyzed. The hypothesis of this work is that cryptocurrencies, as a legal phenomenon, are at the intersection of several legal institutions. In addition, it is assumed that competent and gradual legislative regulation of cryptocurrencies will avoid some risks. The main subject of this research is the legal nature of cryptocurrencies. In this final qualifying work, the following general scientific methods were used: analysis, comparison, synthesis. Also applied are such private scientific and special methods as: historical-legal, formal-legal, logical, forecasting method. The structure of the final qualifying work. The research includes the following sections: an introduction, three chapters, six paragraphs, a conclusion and a list of references and sources. Results of the conducted research. In the course of preparing this work, the existing approaches to determining the nature of cryptocurrencies were highlighted and the optimal one was selected. In accordance with this, proposals were formulated for the development of cryptocurrency regulation in Russia, as well as in other countries of the world. The main risks and benefits of using cryptocurrencies are analyzed, methods of combating illegal ways of using them are analyzed. It was also noted that today there are several problems in the understanding and regulation of cryptocurrencies by the national legislator, which not only prevents circulation, but also creates the possibility of using cryptocurrencies for illegal purposes.
