Elections as a Form of Direct People\'s Will

The elections procedure as a form of direct people’s will is considered in this final qualification work. The elections nowadays are one of the most important institutes of the direct democracy. As the democratic political regimes are widespread the issues of the elections organization and conduction are certainly relevant. The elections are usually the part of the democratic political regime and where the elections rules are broken, so are the patterns of the democracy. The author has conducted a substantial research of the development of the elections institute and their connection with the democracy development. The author also has marked a solid connection between the democracy, the elections and the republic as a form of government, coming to the conclusion that the elections are one of the institutes of the ideal direct democracy. The elections are theoretically the legitimate form of forming the authority, though not all the authorities are formed through them. This is the other big theoretical issue which is relevant even for the countries considered to be the most democratic. The author has researched the interrelation between the elected and appointed authorities and justified the actual existence of the appointed authorities. Besides, the author has considered several practical problems connected with them. They are: the choice of the electoral system, the voting majority calculation method: in the work the Russian and American electoral systems are considered in detail, the remote voting opportunities and the alternative election methods, which are presented by the drawing of lots in this work. All the issues mentioned above are present in the Russian elective legislation and practice and in the legislation and practice of the other countries. This makes the suggested topic relevant for research.
