Legal Mechanisms to Combat Gender Discrimination in Labor Relations

Ensuring human rights and freedoms is recognized by the entire international community. A state that is on its way to democracy, and even more so a state that considers itself democratic, must guarantee rights and freedoms and ensure their realization in all spheres, including the area of labor relations. The state of the practical implementation of the prohibition on gender discrimination in employment relations in the countries of the Western world is rapidly becoming a kind of indicator of the development of society. In the Russian Federation certain guarantees of compliance with the principle of equality and prohibition of discrimination in employment legal relations are embodied, in particular, in the prescriptions of the Constitution of the Russian Federation and other legislative acts. However, the dynamics of social relations calls for further development of the regulatory and legal framework in the field of countering gender discrimination in employment relations and for serious scientific research into the phenomenon of discrimination itself and its prohibition. Being aware of these circumstances, the author sets a goal to conduct a comprehensive analysis of the ways of legal regulation of combating gender discrimination in labor relations, identifying existing problems and making recommendations to improve legal regulation in this area, for the implementation of which he performs a number of tasks. The author studies the concept of discrimination, classifies discrimination on various grounds, and provides a comparative analysis of international and Russian experience in regulating the fight against gender discrimination. As a result, the author proposes a number of amendments and additions to the Russian labor legislation and other normative legal acts containing norms of labor law, aimed at solving the problems highlighted in this work in the area under consideration.
