Legal Regulation of Personal Data

With the development of technology, personal data has come to play a special role in both private and public legal relations. This applies also to labor relations. This study aims to systematically analyze the legal regulation of the institute of personal data of employees, highlighting the weaknesses of the current legislation and to develop ways to improve it. In the area of personal data protection of employees, there are a number of problems that currently remain unresolved by the legislator. As a result of the study, the author proposed ways to solve these problems by adding new provisions to the labor legislation. Also based on an analysis of legislative acts and legal doctrine, the author proposed a definition of personal data. In the context of international and foreign experience was identified a different approach to balancing the interests of the private life of the employee and the material interests of the employer in European countries and in the United States.
