Course Syllabus

Abstract

This course provides an overview of comparative analysis in international law, which is derived from multilateral treaties or general custom, and applies equally to all parties to a treaty. It also introduces students to the comparative method in relation to international law, despite the fact that real-world international legal practice does not always adhere to this classical conception. Comparative international law brings together international law and comparative law to identify, analyse and explain the similarities and differences in how international law is understood, interpreted and applied by different national and international actors. We examine the origins, definitions and characteristics of the international legal order, analyse the establishment of different international regimes, and explore various thematic areas of international legal practices and interactions within the global arena. We also discuss different conceptual enquiries and innovations, and examine the specifics of problem-solving arrangements and the mechanisms of hard rules of international law and treaties, as well as soft law in the form of communiqués and declarations. Our conclusion is that international law is currently undergoing profound changes, with alterations to the normative structure and the international legal order.

  • This course aims to explain the multidimensional nature of comparative international law. It is a framework for analysing global processes involved in forming international legal regimes, and considers the various actors involved, such as state authorities, intergovernmental organisations, non-governmental organisations, private sector entities, transnational corporations and other civil society actors. The course addresses how international law has become a core instrument through which nation-states can achieve national goals and address common problems. It also considers how nation-states can establish international regimes using international law, treaties, conventions and other legal instruments, and how they can reconcile conflicting interests in areas such as global security, arms proliferation, finance, the environment, health, humanitarianism and human rights.

  • — Provide an overview of comparative international law, considering historical and contemporary viewpoints. Describe methods, approaches, concepts and empirical applications relating to comparative international law and the international legal order.
  • — Identify comparative international law as a distinctive phenomenon of particular states or regions in relation to the implementation of international law.
  • — Explain the development of global security, economy, human rights, humanitarian, environmental and maritime treaty regimes through the power-oriented assumptions and national reception. Analyse interstate and transnational dispute resolution processes and the challenges posed by state actions and international legalisation. Consider the impact of sanctions mechanisms on international law given a comparative legal approach.
  • — Introduce the phenomenon of comparative international law and demonstrate how various authoritative bodies have interpreted or applied a specific international law rule or principle.
  • — Combine multiple perspectives and approaches to international law to explain how and why similarities and differences arise across states and among lawmakers, and develop an understanding of the field of comparative international law as a whole.
  • — From realist, ideational and positivist perspectives, explain how nation states understand and maintain security, the economy, the environment, human rights, health, humanitarian and maritime law. Also, explain the role of nation states, international organisations, and non-state actors in maintaining these international legal regimes as an integrated compliance system that addresses national and global challenges.
