Course Syllabus
Abstract
The academic discipline "The Nuremberg trial and the development of international criminal justice" is devoted to an in-depth study of the activity of the International Military Tribunal for the trial and punishment of the major war criminals of the European Axis 1945-1946 and the contribution it made to the formation of a modern system of international criminal justice. The so-called subsequent Nuremberg trials, which took place in the American zone of occupation in 1946-1949, are subjected to a separate study, at which certain representatives of the Nazi elite (judges, doctors, industrialists, etc.) were tried.
Students who have studied the discipline will learn the history of the emergence and development of the idea of an international criminal court; trace the theoretical evolution of the foundations of international criminal justice; will replenish their knowledge of the provisions of the Charter of the International Military Tribunal in Nuremberg, the organization of its activities, as well as the impact that it had on the further development of international criminal justice.
Based on the results of mastering the discipline, students will be able to characterize the historical and legal prerequisites for the creation of the International Military Tribunal; reveal the meaning of the sentences handed down as a result of the Nuremberg 1945-1946 and subsequent Nuremberg trials 1946-1949; master the special terminology used in the field of international criminal justice, as well as the skills of professional argumentation in assessing the validity of international criminal justice acts in courts and tribunals of a new type (in particular, ad hoc international criminal tribunals, the International, Impartial and Independent Mechanism for Syria, etc.).
Learning Objectives
- The goals of studying the academic discipline “The Nuremberg Trial and the Development of International Criminal Justice” are: to form an idea of the background, legal basis, concept and institutionalization of the Nuremberg Tribunal, its general political and legal significance for international criminal justice; familiarization with the essence of the idea of an international criminal court, the doctrinal foundations of international criminal justice; The Charter of the International Military Tribunal, the verdict of the Nuremberg Tribunal, the influence of the Nuremberg Trials on the further development of international criminal justice; fostering a moral attitude towards historical memory, an intolerant attitude towards the distortion of history and the rehabilitation of Nazism.
